Give the tenant notice that they are being evicted. It is typical to give them 30 days to move. It is best to serve them notice before a witness. It can even be videotaped.

If they refuse to move, or you feel they will not be compliant: No sooner than 3-days after notice efforts go to the county court.

Summons of Restitution

When you go to the court you need to ask for a Summons of Restitution. To do this you need to have prepared Praecipe instructions to the court. You will ask the court to prepare a summons of restitution. What this does is forces the noncompliant tenant into court. The judge will ask the tenant why he or she has not vacated. Without a good excuse the tenant will be ordered to vacate by a Writ of Restitution.

Writ of Restitution

A Writ of Restitution directs the Sheriff to remove the tenant and restore the premises to the landlord or allows the landlord permission to change locks unless some other type of action is specified by the court in the Writ of Restitution.
